The three key changes are:
- Bill 37 will introduce automatic certification for a workplace where a union files membership cards establishing more than 50% support for a bargaining unit.
- Bill 37 will prohibit an employer from using replacement workers during a labour dispute, subject to some limited exemptions.
- Bill 37 will require an employer at a unionized workplace and the union to determine whether there are essential services that would need to continue during a labour dispute and if so, to negotiate an essential services agreement or otherwise file an application with the Manitoba Labour Board.
Unionized employers will need to understand these changes and the potential impact on collective bargaining and labour disputes going forward.
As well, non-unionized employers should be aware of the potential for automatic certification of their workforce at any time, and how these changes relate to organizational operations if certification occurs.

She represents employers before arbitration boards, human rights commissions and tribunals, labour boards, workers compensation tribunals and Manitoba Courts.
Devin Wehrle, Associate
Devin practises in the area of labour and employment law, primarily representing management of organizations involved in a variety of industries. Based in Winnipeg, Devin provides strategic advice and assistance to employers on all matters relating to labour and employment. This includes the negotiation and drafting of collective agreements, workplace policies and employment contracts, and assisting employers with workplace investigations, disciplinary matters, terminations, OHS matters and corporate restructurings.
